1. General Information
These General Conditions (hereinafter referred to as the “General Conditions”) govern the terms and conditions under which the services are provided.
The terms and conditions set forth below regulate the provision of this website owned by IMB SCHOOL S.L., (hereinafter IMB SCHOOL), with its registered office in Spain, Barcelona, C/ Torrent de Perales 3, 08028, and CIF B 66662024.
The user is over 18 years old.
The official language of the Terms And Conditions is English.
The user can modify the data before accepting the Terms And Conditions.
IMB SCHOOL will archive the electronic documents in which the contract is formalised.
Users commit to use the Website, Application, and the Contents in accordance with the Law and these General Conditions (and subsequent modifications to them) as well as with the generally accepted good practices, uses, and customs of the Internet and public order.
2. Password use policy
The user will be able to access the Services for which they will be provided a username and password. The generated username and password will allow the user to identify themselves and access the services offered by IMB School.
The user assumes responsibility for maintaining the confidentiality of their passwords.
In the event of notification of loss or theft, the user must proceed immediately to change their password. IMB School will provide established procedures so that the user can freely change their password.
IMB School may block access to and use of the Services when deemed necessary for security reasons.
3. Data protection policy
The personal data provided to IMB School, as well as those provided throughout the contractual relationship as a student, will be incorporated into a computerised data file and used only by IMB School.
IMB School has adopted adequate security measures for automated files containing personal data, for which it has established all the technical means at its disposal to prevent loss, misuse, alteration, and unauthorised access.
The purpose is to manage, prepare, and properly follow up on the course, including the management of issuing certificates and titles, as well as the management of payments and collections that IMB School must carry out, and all issues arising from the status of a student or former student.
In the case that access to the platform and course is acquired by a company as part of corporate training, this data will be provided to the company for which you work.
Users have the possibility to exercise their rights of access, rectification, deletion, withdrawal of consent, and opposition. Users also have the right to lodge a complaint with the Spanish Data Protection Agency, limit the processing of personal data concerning them, the right to delete personal data transmitted to the data controller, and the right to data portability.

4. Image rights authorisation
By including the image under these conditions, its dissemination is accepted in accordance with Law 1/1982, of May 5, on Civil Protection of the Right to Honor, Personal and Family Privacy, and One’s Own Image.
Images and other personal data will be treated as personal data, in accordance with the data protection policy adapted to the European Regulation 679/2018.
5. Confidentiality
The user agrees to use any confidential information solely for their own knowledge and learning, but under no circumstances may it be shared with third parties by any means or in any format.
The user understands that in the event of a breach of these confidentiality terms, they are fully responsible for any damage or harm that may be caused to IMB SCHOOL.
This obligation is of an indefinite nature.
6. Intellectual property
IMB SCHOOL grants personal, non-transferable, non-sublicensable, and revocable licences for use. The contents of the service are protected by regulations concerning copyright, trademarks, and other property rights. The copyright and trademark owners are IMB SCHOOL.
The user may not modify, copy, reproduce, republish, upload, transmit, or distribute any material from this service including text, graphics, code, and software, except with prior written consent from the owners.
Specifically, the client may not use tools to collect or copy any content or data related to the service or its users in a manner not authorised by IMB SCHOOL. IMB SCHOOL reserves the right to unilaterally revoke the licence granted if the user engages in unauthorised activities.
Additionally, the recording of voice, screen recording, taking photographs, or videos of any live broadcast and in-person session at IMB SCHOOL for any module is strictly prohibited.
Violation of any of these clauses will constitute an infringement of intellectual property rights and may lead to significant penalties based on the damages caused to IMB SCHOOL, who reserves the right to undertake appropriate legal and judicial actions if necessary.
IMB SCHOOL has a team dedicated to tracking digital content.

As a CONSUMER, you may request a complaint form at our registered office or download one from consum.cat.
8. Applicable law and jurisdiction
These general conditions are governed by Spanish law. Any controversy arising from the interpretation or execution related to the validity, interpretation, fulfilment, or resolution of this contract will be subject to the Jurisdiction and Competence of the competent Courts and Tribunals.
9. Electronic Contracting (where applicable)
PURCHASE PROCESS
The purchase process consists of several steps:
FIRST: To make a purchase, you must confirm the purchase and then proceed to your bank payment platform.
SECOND: Immediately after, IMB SCHOOL will send an email to the user confirming the purchase. This email will assign a reference code for the purchase and will detail the characteristics of the product and its price.
THIRD: The order confirmation sent by IMB SCHOOL is not valid as an invoice, only as proof of purchase.
PRICES
The prices listed in the service lists include VAT unless otherwise indicated.
In the final purchase summary, the total price including taxes will be displayed.
PAYMENT SYSTEM
You can make payments using either a credit or debit card.
RIGHT OF WITHDRAWAL
The law grants consumer clients the right to withdraw from their purchase within a period of fourteen working days, starting from the day of the contract.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement by email at contact@imbschool.eu.
We will acknowledge receipt of your withdrawal.
In case of your withdrawal, we will refund all payments, unless the course material has been accessed.
Money will be refunded to the same card used for the initial transaction, unless expressly specified otherwise.
ALTERNATIVE DISPUTE RESOLUTION
This company maintains an active conflict resolution policy and provides customer service to facilitate this. We inform you that, according to Article 40 of Regulation (EU) 7/2017, the European Commission has made available an online dispute resolution platform that is accessible via the following link.
However, the company will decide on a case-by-case basis whether to adhere to this system, as we believe that conflicts can and should be resolved outside of these mechanisms. Therefore, we advise you to use our customer service system before making any claims.
